Terms of service

Before you read this

This is a plain-language summary of our terms. If anything here is unclear, call us at (850) 905-6463 and we’ll explain it. We would much rather spend ten minutes on the phone than have you agree to something you didn’t follow.

Section 1

Who we are

Vividly is a trading name of Resonating Ventures LLC, a Florida limited liability company with its principal address at 851 E Ten Mile Rd, Pensacola, FL 32514.

In these terms, “we,” “us,” and “Vividly” mean that company. “You” means the person booking or paying for a service. “Storyteller” means the person whose life story is being recorded, who is often not the person paying.

These terms cover both of our services. By booking either one, you agree to them.

Section 2

What we offer

Photo digitization

We scan photographic prints, restore and organize them, and return them to you digitally on a USB drive. We do this either at your home, across the Gulf Coast from Destin to Mobile, or at our studio in Pensacola. This service is local.

Vividly Voice

A trained human interviewer calls the storyteller by telephone and has a recorded conversation about their life. Sessions are recorded, divided into individual stories, and transcribed into an archive. At some package levels the transcripts also become a printed hardcover memoir. This service is national.

Every Vividly Voice interview is conducted by a person. We do not use automated or synthetic interviewers.

Section 3

Booking, deposits, and payment

Photo digitization
A $99 deposit is taken when you book, and it is applied to your total. The balance is due on delivery, once the collection has been counted and scanned.
Vividly Voice packages
Paid in phases. Each phase is invoiced and due before the work that phase funds begins. See section 4.
Vividly Line
An annual subscription, paid in advance.

Card payments are processed by Stripe. Your card details go to Stripe, not to us. We never see or store your full card number.

Prices shown on this website are in US dollars and do not include any applicable sales tax, which is added where required.

Section 4

Phased payment and cancellation

This section covers Vividly Voice packages. It is the part people most often want explained on the phone, so it is written as plainly as we can manage.

  • Each phase is invoiced before the work in that phase begins. Nothing is charged for work that has not started.
  • You may stop after any completed phase. Tell us by phone or in writing — you do not need to give a reason.
  • You keep everything already produced. Every recording made, every transcript, and the archive itself. Stopping does not take anything away from you.
  • Any phase that has not yet started is refunded in full.
  • If the storyteller dies, or becomes unable to continue, we deliver everything recorded up to that point and refund all unstarted phases. There is no cancellation fee and no paperwork beyond telling us.

Refunds are returned to the original payment method within 10 business days.

Section 6

Ownership of recordings and archives

The storyteller owns their recordings and transcripts — not the person who paid for them, unless those are the same person. This is deliberate, and it is not negotiable at checkout.

Recordings and transcripts are available to download in standard file formats at any time. Download access does not depend on an active package and continues after one ends, so a copy can be kept independently of us.

The storyteller designates who may listen, who may manage access, and who the archive passes to.

We retain a working copy of recordings and transcripts solely in order to deliver the service. See our Privacy Policy for how long we keep it.

Section 7

Photographs for printed memoirs

To print a memoir with photographs in it, we need family photographs and captions from you. We cannot source them ourselves.

  • We remind you at 60, 80, and 88 days after the final session.
  • If we have not received photographs and captions within 90 days of the final session, we produce a text-only edition and apply a credit of $500 to your account.
  • A text-only edition is a complete book. Same content, same codes beside each story, same binding. It simply has no photographs in it.

We do this because a book that never gets printed helps nobody, and because the recordings are the part that cannot be recreated later.

Section 8

Printed materials and codes

  • The codes printed beside each story in a memoir resolve through a redirect that we maintain.
  • Every Legacy Edition includes a USB drive with all of the recordings on it. The book does not depend on our systems continuing to run, or on us continuing to exist.
  • We may change where files are hosted or stored over time. When we do, we update the codes so that they keep working.
Section 9

Photo digitization

  • In-home visits have minimum collection sizes that vary by zone. They are published on the photo digitization page and stated again before you book.
  • Studio drop-off has no minimum.
  • Studio drop-offs are counted and receipted at intake, in front of you. They are kept in our Pensacola studio and are never mailed anywhere.
  • We handle photographs with care. We are not liable for pre-existing damage, fading, curling, adhesion, or deterioration that was already present.
Section 10

Conduct and interviewer safety

Interviewers are engaged as contractors, and we recruit from backgrounds such as hospice, teaching, and ministry. We will not ask them to sit through abuse.

An interviewer may end a session, and we may end an engagement entirely, in response to abusive, threatening, or harassing conduct toward our staff or contractors. If we end an engagement for this reason, we refund any unstarted phases and deliver everything already recorded.

Section 11

Limitation of liability

Some states do not allow certain limitations, and where that is the case, the limitation applies only as far as the law permits. Nothing in these terms limits liability for fraud or for anything else that cannot be limited by law.

Section 12

Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules.

Any dispute arising out of these terms or the services will be brought in the state or federal courts located in Escambia County, Florida, and both sides consent to the jurisdiction of those courts.

Section 13

Changes to these terms

If we change these terms, we post the updated version on this page with a new “last updated” date at the top. The version in effect when you book is the version that applies to that booking.

We do not change terms retroactively for work already paid for.
